Because the Japanese and U.S. systems for medical insurance differ greatly, one gets the impression that medical insurance in the U.S. is complicated. If your employer provides insurance, that is good, but if not, you must purchase private insurance on your own. Furthermore, the Obama administration’s health care reform (commonly known as Obamacare) has made it mandatory for citizens to purchase insurance from January 1, 2014. Accordingly, the Medical Insurance Marketplace (Marketplace) was launched on October 1, 2013, allowing people to easily compare insurance plans. In addition, low-income public health insurance such as Medicaid is now available through the Marketplace.

This section introduces the screening tools (how to use the New York State Marketplace) for those who do not have medical insurance, as well as the public health insurance (Medicaid, Child Health Plus, and Essential Plan) offered by the New York State government for low-income households. First, financial troubles. If you have a financial dispute and the amount you owe is less than $5,000, you can file a small claims case in court yourself without hiring an attorney.

Internet fraud, where your credit card information is misused when you shop on the Internet, and identity theft, where your address, name, social security number, etc. are stolen and a credit card is created without your permission, are also troublesome consumer problems.

In addition, childhood immunizations are required before your child is admitted to kindergarten or school in the United States. It is not uncommon to be required to re-administer vaccinations if there are some vaccinations in the U.S. that are not included in the Japanese immunization program, if there is no proof of previous vaccinations or history of illness, or if vaccinations administered outside the U.S. are not recognized. In order to prevent this, it is essential to have a mother-child handbook, immunization record, or other proof of immunization. “Public charge” or the “public charge test” is used by immigration officials to decide whether a person can enter the U.S. or get a green card (lawful permanent resident or “LPR” status). In this test, officials look at a person’s circumstances, including income, employment, health, education or skills, family situation, and whether a sponsor signed a contract (“affidavit of support”) promising to support the person. Officials can also look at whether a person has used certain benefit programs (in the past, only cash assistance and long-term care were counted).

The government is changing how it makes public charge decisions. Immigration officials will look more closely at factors like health, age, income, skills (including English language skills), and use of more public programs, including:

Supplemental Nutrition Assistance Program (SNAP, “EBT” or “Food Stamps”)

Federal Public Housing and Section 8 assistance
Medicaid (except for emergency services, children under 21 years, pregnant women, and new mothers)
Cash assistance programs (like SSI, TANF, General Assistance)

*Services not listed above will not be counted in the new public charge test. This includes WIC, CHIP, school lunches, food banks, shelters, and many more

The new changes will not be used by immigration officials until October 15 and will apply only to applications that are postmarked or submitted electronically on or after October 15. If you are applying for a green card in the U.S., the use of the non-cash benefits listed above will not be counted in a public charge test.

The rule will also not count any programs (other than cash or long-term care) used before October 15, 2019. You still have time to decide whether or not to stay enrolled in critical public programs.
Programs used by your U.S. citizen children will not be used against you.

It will not affect the citizenship applicants and Green Card renewal. Green Card holders are not impacted either; however, if you plan to leave the country for more than six months, it is a good idea to talk with an immigration attorney.

The rule may be blocked or delayed further with legal challenges.

As a result of the ACA, young adults up to age 26 are able to stay on their parents’ plan, there is additional drug coverage for people with Medicare, there are more free preventive services, and lifetime limits were removed from health insurance. In addition, beginning on January 1, 2014, discrimination due to preexisting conditions or gender has been prohibited, annual limits on insurance coverage has been eliminated, Advanced Premium Tax Credits (APTC) are available, more people are eligible for Medicaid in some States, and coverage through the Health Insurance Marketplace has started.

If you are a long-term resident in Japan and become ill during a short stay in a foreign county, your National Health Insurance may cover a portion of your medical expenses overseas.

However, there are exceptions such as:
\n1) Treatment that are not covered by National Health Insurance even in Japan, and
\n2) When the insured traveled abroad for the purpose of receiving medical care.

Also, those who live outside of Japan for more than a year are not eligible for this program.

Since only those who have addresses in Japan may claim National Health Insurance, only foreign nationals who have re-entry permits when they leave Japan are eligible. National Health Insurance does not cover bills incurred during lengthy stays abroad. In order to claim insurance, you will need:

\n• Your National Health Insurance Card

\n• A bankbook in the householder’s name

- Primary Care Providers and other medical providers who are HIV Specialists
- Additional HIV specialty services:\n
  - HIV SNP Care Coordination: A Care Coordinator can help the consumer make medical and behavioral health appointments and manage their care. An HIV/SNP Care Coordinator can help the consumer and their family get counseling, public benefits, substance use disorder treatment, legal help, public benefits, and other services.
  - Treatment Adherence Services: Treatment adherence services help the consumer remember and keep track of their medications, manage any side-effects from medications, and give advice about new medicines and treatments.
  - HIV Prevention and Risk-Reduction Education: This education can include counseling, reading materials, and health education classes. This education can help the consumer reduce the chance that they may get new infections or infect others, by letting the consumer know:\n
    - how to get free male and female condoms;
    - where to get clean needles and syringes;
    - where to get counseling services to help stop injection drug use;
    - how to talk to their partner about ways to reduce HIV risk and infection, including PrEP and PEP.\n
      - PrEP is a daily pill for HIV-negative people that can help prevent HIV infection before exposure to the virus.
      - PEP is an emergency medication for HIV-negative people that can help prevent infection after exposure to HIV.

Through H+H Options, low and moderate-income H+H patients can get affordable healthcare. H+H helps patients apply for public health insurance programs for which they may qualify. Section 8, also known as the Housing Choice Voucher Program, provides federal funding for subsidies for eligible low-income families to rent decent, safe, and affordable housing in a neighborhood of their choice. Families pay a reasonable share of their income toward rent and the subsidy, paid by HPD directly to the landlord, makes up the difference, within specified limits. The unit must also meet federal Housing Quality Standards and will be inspected prior to move in and once annually.

HPD provides vouchers to families in buildings developed or renovated under certain HPD programs, and to homeless individuals referred by Department of Homeless Services and Human Resources Administration providers. Applications must be submitted through designated intermediaries from within HPD, management staff from various housing providers, or staff from other City agencies. Applications are not accepted by the general public.

The New York City Housing Authority (NYCHA) and New York State Homes and Community Renewal (HCR) also operate Section 8 programs in New York City. NYCHA and HCR are no longer accepting new Section 8 applications. You may consult their websites for more information.

“Since 1985, the Lifeline program has provided a discount on phone service for qualifying low-income consumers to ensure that all Americans have the opportunities and security that phone service brings, including connecting to jobs, family, and emergency services. In 2005, Lifeline discounts were made available to qualifying low-income consumers on pre-paid wireless service plans and traditional landline services. Lifeline is part of the Universal Service Fund.

The Lifeline program is available to eligible low-income consumers in every state, territory, commonwealth, and on Tribal lands. Consumers with proper proof of eligibility may be qualified to enroll.

To participate in the program, consumers must either have an income that is at or below 135% of the federal Poverty Guidelines or participate in one of the following assistance programs:

Medicaid;
Supplemental Nutrition Assistance Program(Food Stamps or SNAP);
Supplemental Security Income (SSI);
Federal Public House Assistance (FPHA);
Low-Income Home Energy Assistance Program (LIHEAP);
Temporary Assistance to Needy Families (TANF);
National School Lunch Program’s Free Lunch Program;

Federal rules prohibit eligible low-income consumers from receiving more than one Lifeline discount per household. An eligible consumer may receive a discount on either a wireline or wireless service, but not both. A consumer whose household currently is receiving more than one Lifeline service must select a single Lifeline provider and contact the other provider to de-enroll from their program. Through a federal grant from the U.S. Department of Education, Rehabilitation Services Administration (RSA), the Justice Center administers the Technology-Related Assistance for Individuals with Disabilities (TRAID) Program. TRAID’s mission is to coordinate statewide activities to increase access to and acquisition of assistive technology in the areas of education, employment, community living and information technology/telecommunications.

The program’s goal is to increase access to and acquisition of assistive technology in the areas of education, employment, community-living and information technology/telecommunications. The Justice Center supports 12 Regional TRAID Centers (RTCs), where staff provides information, training, device demonstration, device reuse, device exchange, and device loans. TRAID staff also provides technical assistance and advocacy on how to obtain and use assistive technology services and devices.

The TRAID Program, in collaboration with the NYS Department of Health Early Intervention Program, provides partial funding to the RTCs for device loan libraries for infants and toddlers with disabilities, ages birth to three, and their families (NYS Justice Center).

Seniors can apply for EPIC at any time of the year. They must be enrolled or eligible to be enrolled in a Medicare Part D drug plan to receive EPIC benefits and maintain coverage.

EPIC helps pay the Medicare Part D drug plan premiums for low to moderate-income members. EPIC also provides supplementary drug coverage for Part D-covered drugs and Part D excluded drugs purchased while in the Medicare Part D coverage gap.

[ Senior Citizen Rent Increase Exemption (SCRIE) = NYC Rent Freeze Program ]
\nIn 1970, the City of New York began the Senior Citizen Rent Increase Exemption (SCRIE) program, offering qualifying senior citizens an exemption from future rent increases. In 2005, it was expanded to include qualifying tenants with disabilities under the Disability Rent Increase Exemption (DRIE) program. Together, SCRIE and DRIE are known as the NYC Rent Freeze Program. This program. This program helps eligible senior citizens (aged 62 and over), and tenants with qualifying disabilities stay in affordable housing by freezing their rent. Under this program, a property tax credit covers the difference between the actual rent amount and what you (the tenant) are responsible for paying at the frozen rate (NYC Finance).

“Since 1985, the Lifeline program has provided a discount on phone service for qualifying low-income consumers to ensure that all Americans have the opportunities and security that phone service brings, including being able to connect to jobs, family and emergency services. HOW TO SUE IN SMALL CLAIMS COURT

Go to Small Claims Court in either the borough where you live or where the person or party you are suing (defendant) lives or works.
\nFill out an application and pay the clerk a small filing free–individuals pay a small fee while businesses pay a slightly higher fee–which covers the cost of preparing and sending a summons by certified mail to that defendant.
\nIn the application, provide your name and address, why you are suing, and the amount you are suing to recover. Also, include any provable expenses or losses incurred because of what happened to you, such as the cost of using taxis while your damaged car was being repaired.
\nWrite the exact name and the home or business address of the defendant. The name of the person or business must be complete and correct. If the defendant does business under a trading name such as “Fizzie Appliances” or “Fizzie’s,” you will need to know its legal name, which might be “Fizzie’s Appliance Store, Inc.” To obtain the real name, go to the office of the County Clerk in the borough where the business is conducted.

PREPARING YOUR CASE

You will need originals or copies of all relevant documentation such as receipts, contracts, and canceled checks. You may wish to prove damages by bringing the damaged item to court, showing photographs of the item before and after the damage occurred, or submitting the report of a repair person. You may present witnesses as long as they know the facts. Witnesses essential to your case may be subpoenaed if necessary.

THE TRIAL

The case is hared by a judge, or if all parties consent, by an arbitrator, a lawyer. If you choose an arbitrator, your case will be heard much sooner than with a judge and in an informal setting rather than in a courtroom. You must understand that an arbitrator’s decision is binding and may not be appealed. Proceedings are simple. Each side has the opportunity to explain its position and produce witnesses and documentation.

THE JUDGEMENT
\nTHE MAXIMUM AMOUNT YOU CAN SUE FOR IN SMALL CLAIMS COURT IS $5,000.00.

If a judgment is awarded in your favor, you should try to contact the defendant to collect your judgment. If the defendant does not pay you, you should seek the assistance of a sheriff or city marshal located in the county in which the defendant lives or works. You must provide the sheriff/marshal with the information needed to locate the defendant’s assets (money or property), and the sheriff/marshal can seize those assets to satisfy your judgment. The sheriff/marshall may request mileage and other fees before seizing the assets. In many circumstances, these fees later can be added to the original judgment amount–which covers the cost of preparing and sending a summons by certified mail to the defendant.
\nAn enforcement officer may seize property, including bank accounts, wages, houses or other real estate, automobiles, stocks, and bonds. Upon satisfactory completion, you will receive a check from the sheriff’s or marshal’s office.

When an uninsured or insured person with a low coverage rate receives treatment at a hospital or clinic, you may be asked to pay full medical expenses, regardless of your ability to pay. Therefore, many people have debts due to high medical expenses and going bankrupt. To prevent this, it is important to meet directly with the financial counselor of each hospital to discuss whether it is possible to reduce medical expenses and take out insurance, including public medical insurance.

To reduce medical expenses in the hospital, please refer to the H+H option that you can have a medical examination at a rate according to your income without insurance. Also, there are assistance programs at New York-Presbyterian Hospital. Please call New York-Presbyterian/Columbia University Medical Center at (212)-632-7440, NewYork-Presbyterian/Weill Cornell Medical Center at (866)-252-0101 for more information.

When an out-of-network doctor charges many medical expenses at an in-network hospital.

Despite being insured at an in-network hospital, you may be charged many medical expenses from an out-of-network doctor. Primarily in cases such as surgery, these out-of-network doctors include radiologists, anesthesiologists, pathologists, and surgeons who assist in-network surgeons.

Some insurance plans do not cover out-of-network medical expenses and must pay their own expenses. Also, some plans only cover a part of the out-of-network medical expenses, but you still have to pay the difference between the amount charged by the doctor. This is called a “Balance Bill.”

The best way to prevent this is to consult with your doctor before scheduling a surgery to ensure that all doctors are in-network. If you already have a large medical bill, you can negotiate with your out-of-network doctor to reduce your medical bill.

In the case of an emergency, including an accident or a heart attack, there is no room to choose a hospital. It is usually transported to the nearest hospital. When the condition is settled, it is usually transported to an in-network medical institution. However, it must be the “medical emergency” defined below. In these cases, most plans cover emergency care, regardless of out-of-network. Contact your insurance company for more information on emergency coverage and more.

“A condition with acute symptoms of sufficient severity (including severe pain) that a person who possesses an average knowledge of health and medicine could reasonably expect the absence of immediate medical attention to result in–(1) placing the health of the individual (or an unborn child) in serious jeopardy, (ii) serious impairment of bodily functions, or (iii) serious dysfunction of any bodily organ or part.”

So what do you do when you receive a medical bill from an out-of-network doctor?

If you are in emergency care, please contact your insurance company and tell them that you have a medical bill from an out-of-network doctor for emergency treatment. Depending on the plan, medical expenses may be covered in full.
Doctors have no obligation to reduce, but they may be able to reduce. Contact the out-of-network doctor who made the medical bill and try to negotiate if they can reduce it. You can also have agencies that negotiate medical bills like Medical Bill Mediation, Medical Cost Advocate, etc., act on your behalf and ask your doctor to reduce it; however, there is no guarantee.
Find out the out-of-network reimbursement rates for your insurance plan and make a claim using your insurance company’s claim form.
If the insurance company denied your claim, please contact them first to find out why they denied it. There may be a mistake on the claim.
Appeal if you receive a Denial Letter from the insurance company. In many cases, the Denial Letter has instructions on how to appeal. Follow the instruction to create an appeal letter and mail it to the insurance company. (Appeal letter sample by Community Health Advocates)
Complain to New York State Financial Services with all the documents printed out at the time of appeal.

＊Please copy all the documents mailed to the insurance company, indicate the date you mailed them, and keep it as your record. Some insurance companies may have set an appealing period, so please do it immediately.

A Custody Order gives responsibility for the child’s care and how the child is brought up to one or both of the child’s parents or to someone else. There are two parts of custody: (1) legal custody and (2) physical custody.

A New York court can make orders about the child’s custody only until the child is 18 years old. The Court gives custody based on what is best for the child, this is called the best interest of the child.

The Office of Child Support Enforcement (OCSE) ensures that noncustodial parents (NCPs) provide financial support for their children and serve as a strong anti-poverty program. Child support can help keep families financially independent and eliminate the need for cash assistance. OCSE helps custodial parents and guardians, regardless of income and immigration status. Services include the location of the noncustodial parent, summons service, assistance with the establishment of paternity, child support and medical support orders, and collection and enforcement of those orders.

Parents and guardians applying for or receiving cash assistance are automatically referred to OCSE for child support services. They are required to comply with child support to receive full cash benefits. Non-cash assistance recipients may apply for services by visiting the OCSE office in the family court in the borough.

There are two types of programs, Early Head Start and Head Start, designed to help children from low-income families and children with disabilities develop social skills and reach their full potential. Children from applicable families are eligible for a free child care program called the Head Start Program. Federal grants fund it.
\nThe Head Start program promotes school readiness by nurturing children’s social skills and enhancing their overall development through comprehensive educational, medical, nutritional, and welfare services to enrolled children and their families. The program also encourages parental intervention in their children’s learning and helps parents fulfill their educational, knowledge, and employment goals. We specifically focus on parental involvement because children learn from their parents.

[ Early Head Start ]
\nEarly Head Start is an annual program for pregnant women from low-income families and their children up to age three and their families. Children and parents enrolled in Early Head Start receive a quality pediatric education in a warm environment, parent education and engagement, health and mental health referrals, including pre-mom education, and family support on nutrition.

[ Head Start ]
\nHead Start is a program for low-income families with children ages 3-5. The program provides (1) educational services (a warm environment where each child can reach their full potential, individualized lesson plans with teachers, evidence- and research-based curriculum, education for children with special needs, and literacy activities for children and parents), (2) health services (medical, dental, vision and hearing screening and treatment, nutrition services including diet and counseling, health education, mental health screening, and referral, and assistance in finding a primary care physician for the family), ③ Family services (family initiatives, referral to community systems, assistance in establishing family goals, Parent Policy Council, parent education programs, help in developing skills to advocate for one’s rights, and support in transitioning from Head Start to public school).

\nTo be eligible for the Head Start program, you must meet either (1) categorical eligibility or (2) income-based eligibility.

There are many quality Pre-K programs in New York City that are free of charge. Pre-K for All operates five days a week from September through June, offering full-day (6 hours and 20 minutes, or 5 hours) and half-day (2.5 hours and ) timetables. Children living in New York City who turn four years old are eligible to participate in the school year that begins in September of the same year.

\nThose who apply online will confirm their offer in their own account that they created. You can also call 718-935-2009 to confirm your offer.
\nIf you accept the offer, make an appointment with the offered program by the deadline and bring the required documents to register for a lease with the same program with your child.
\nIf you would like to look at other program options, you may apply during the second application period (Round 2), which includes new programs and programs that still have openings. The order is not based on the number of students.
\nIf you are not offered the Pre-K program of your choice first, you will automatically be placed on a waiting list.
